1. Who runs the auction

The Sunset Concert Auction Organisers run this online silent auction to raise funds for the Pisarski family. This auction is independent of the Pisarski family’s GoFundMe campaign.

Winning bidders pay directly to a payment account nominated by Hayden’s father. The organisers do not hold, process or receive those funds.

2. Who can bid

You must be at least 18 years old to place a bid. By placing a bid, you confirm that you are 18 or older and can enter into a binding payment commitment.

3. How bidding works

Each lot has an opening bid and a displayed minimum next bid. A bid is accepted only when the auction system confirms it. A message sent through the contact form is not a bid and does not reserve a lot.

Each lot closes at the time displayed on its page. A bid placed within the final three minutes of a lot extends that lot’s close by three minutes. The extension applies only to that lot.

The highest valid bid when a lot closes wins. If bids are equal, the earlier accepted bid wins.

4. Your commitment if you win

A bid is a commitment to pay the amount you submit if you are the highest valid bidder when the lot closes.

We will contact the highest bidder using the mobile number or email supplied with the bid and send the direct payment details for Hayden’s father. The winner must arrange payment within 24 hours of our contact. If payment is not confirmed within that period, or we cannot reach the winner, we may offer the lot to the next-highest valid bidder.

Once Hayden’s father confirms payment, the organisers will release the prize. We will discuss handover with the winner and arrange collection, drop-off, or another agreed method.

5. Prizes

Prize descriptions, approximate values and any conditions are shown on the relevant lot page. Vouchers and donated goods remain subject to any conditions, expiry dates, availability and redemption rules set by the donor.

Prizes are not redeemable for cash, transferable for another prize, or exchangeable for an alternative. The organisers will make reasonable efforts to describe each prize accurately, but cannot guarantee a donor’s future availability or fulfilment beyond the information supplied by that donor.

6. Fair administration

The organisers may pause bidding to address a genuine operational issue, correct an obvious listing or system error, or invalidate a bid that appears fraudulent, abusive or made in bad faith. We will not use this power simply to change the winner.

We may cancel or withdraw a lot if it becomes unavailable. If that happens, we will contact the affected bidder and no payment will be requested for that lot.

7. Fundraising and tax

This is a community fundraiser for the Pisarski family, not a registered charity. Payments are not tax deductible.

8. Privacy

We collect the information needed to administer bids and contact winners. Please read our Privacy Policy for details about collection, use, storage and deletion of personal information.

9. Liability and law

Nothing in these terms excludes rights that cannot lawfully be excluded. To the extent permitted by law, the organisers are not responsible for indirect loss, disappointment, or a donor’s separate terms or failure to honour a voucher after it has been released.

These terms are governed by the laws of New South Wales, Australia.
